# TryMyDays Terms of Service

These Terms are between you and Geonwoo Park, operating TryMyDays personally (“TMD”, “we”, “us”). They govern our TryMyDays apps and related websites and features (the “Service”). Contact: support@trymydays.com; 403-944 East 8th Avenue St, Vancouver, BC V5T 1T8, Canada.

## 1. Your agreement and eligibility

By selecting “I agree” or another control that clearly states you accept these Terms, you agree to these Terms, the Community Guidelines (https://trymydays.com/community-guidelines/), and the Creator and Content Licence (https://trymydays.com/creator-licence/). Read the Privacy Policy (https://trymydays.com/privacy/) for information about personal data. The Country Addenda included below apply where stated and take priority on the relevant local issue. The Creator and Content Licence controls the scope of content permissions; these Terms otherwise control. Separate terms may apply to a feature if presented to you.

You must be at least 18 years old. You must provide accurate account, age and residence information and keep it current. Do not impersonate anyone, share another person's credentials, bypass eligibility or safety controls, or access the Service where it is unavailable or unlawful. The current Beta is available only in Canada excluding Quebec, and the United States excluding Texas, Mississippi, Tennessee, Florida and all US territories; the District of Columbia is included. Australia, New Zealand, Singapore and other countries are not in this Beta. Access from another location does not grant eligibility.

You represent that you may lawfully use the Service and grant the permissions you provide. If you act for an organization, you must have authority to bind it. Nothing in these Terms overrides rights that applicable law gives a person who lacks contractual capacity. We may request information reasonably necessary to resolve eligibility or account-security concerns; we do not represent that all users have been identity-verified.

## 2. Your account

Protect your credentials and devices, use the Service only through authorized means, and notify us if you suspect unauthorized access. You are responsible for activity you authorize or cause through failure to take reasonable care, subject to applicable law. You may not sell or transfer your account without our written permission. Usernames and features are subject to availability; we may change a username to address impersonation, rights complaints or operational needs.

You can request correction or deletion even when ordinary access is blocked for eligibility or enforcement reasons, subject to necessary verification and lawful restrictions. Deletion does not entitle you to restore a former account. A new account is separate and remains subject to eligibility and any lawful enforcement restriction.

## 3. Days, Steps, Tries and Results

An “Original Day” is a creator's activity post. A “Step” is an instruction within it. A “Try” is a participant's attempt. A “Result” is a participant's published record, including a “Sync” that incorporates permitted material from an Original Day. “Content” includes videos, audio, images, text and other material submitted to the Service.

TMD supplies a platform. Users decide what to post, whether to try an activity, and how to behave. We do not organize, supervise, direct or control an activity merely because it appears on the Service. A post, ranking, completion count, category, cost estimate or moderation decision is not our endorsement, certification or assurance of safety, legality, quality or suitability. Other users may be inaccurate, misleading or unqualified.

## 4. Activities and interactions are your decisions

Before filming, posting or attempting an activity, independently assess your skills, health, equipment, surroundings, weather, transport, supervision needs, permissions and local rules. Obtain appropriate advice or training where your circumstances require it. Follow venue, property, employment, access, age, alcohol, driving and other applicable rules. Do not trespass, endanger someone, film where prohibited or follow an instruction that is unsafe or unlawful. You may adapt, skip or stop an activity. Completion is never more important than your judgment.

You voluntarily assume the ordinary and inherent risks of real-world activities and interactions you choose, including foreseeable risks of injury, property damage and financial loss, to the extent applicable law permits. You are responsible for your own conduct and for permissions required from participants, bystanders, property owners and rights holders. This allocation does not exclude liability that cannot lawfully be excluded, including our own non-excludable negligence or statutory duties.

Ordinary Content is not medical, health, fitness, legal, financial, safety or other professional advice. Do not use the Service for emergencies. We do not promise to monitor every post, verify every user, provide real-time intervention, or make an activity safe. Use your own judgment in communications or offline meetings, and do not disclose information that puts you or another person at risk.

## 5. Content ownership, permissions and conduct

You retain ownership of your Content. You grant the permissions in the Creator and Content Licence so that the Service and authorized participant uses can work. You represent and warrant that you own or have obtained the rights and permissions necessary to submit and authorize the relevant use of your Content; your Content, instructions and authorized uses do not violate law or another person's copyright, music, privacy, publicity, likeness, confidentiality, property or other rights; and material factual claims you make are not knowingly false or misleading.

Permission to enter a venue, record a person or use a music track is not necessarily permission to publish or commercially reuse it. Obtain the permissions actually needed. Do not imply another person's endorsement without authority. If we reasonably request rights information to handle a complaint, cooperate with information you can lawfully provide. These warranties do not transfer responsibility for TMD-supplied material to you.

Do not upload prohibited material, threaten, exploit, harass or deceive people, manipulate engagement, evade enforcement, introduce malware, interfere with the Service, scrape personal data, bypass access restrictions, or use automated means contrary to authorized interfaces. Do not use the Service or another user's Content to train a general-purpose AI model or build a competing content dataset without permission from the relevant rights holders and TMD for access to its systems. This restriction does not limit rights that law makes non-waivable.

## 6. Moderation and enforcement

We may review reports and Content and take proportionate action where we reasonably believe necessary to enforce these Terms, comply with law or platform requirements, protect rights or safety, prevent fraud or abuse, or operate the Service. Actions may include removing Content, blocking an affected feature or content dependency for technical or legal reasons, or suspending or disabling an account. We may act immediately where urgency, security, legal process or the nature of a violation warrants it. We may explain a decision or accept a request for review where appropriate, but may withhold information that would compromise safety, privacy, security or lawful investigations.

Report concerns through the Service or the Safety Center (https://trymydays.com/safety/). Specific statutory notice procedures have their own requirements. A decision not to remove Content is not a legal determination or assurance that it is safe. We may remove material prohibited by our rules even if it is not unlawful. No user has a contractual right to demand that another user be punished or that a particular post remain available.

## 7. Removal and account deletion

You may remove Content and request account deletion as described in Account and Data Deletion (https://trymydays.com/account-deletion/). Ordinary Removal of an Original Day may leave already-published lawful Syncs available under the narrow licence you granted. Strong Removal ends creator-media reuse and removes your audiovisual contribution and TMD-supplied creator attribution and profile/avatar links from dependent outputs under our control, while allowing lawful participant-only Results to remain. Account deletion applies Strong Removal to your creator Content by default.

We may retain restricted copies or minimal records where reasonably necessary for legal compliance, security, claims or another lawful purpose described in the Privacy Policy. Such retention does not authorize continued public display. Copies independently obtained by other people or services may be outside our control. Keep your own copies of material you need; we do not provide an archival guarantee.

## 8. Service changes and future business models

The initial Service is free. We may develop, test, change, limit or discontinue features, and may later offer paid features, subscriptions, sponsored or promoted Days, advertising, creator-brand arrangements or other lawful monetization. A future charge requires the applicable price and purchase terms to be presented and your affirmative purchase authorization. These Terms do not enroll you in a subscription or authorize us to charge you. Relevant privacy notices and legally required choices will accompany new data uses.

We may make operational changes for legitimate business, security, legal or technical reasons. Where a change materially disadvantages a consumer under an ongoing commitment, we will provide any notice, cancellation opportunity or remedy required by law. No representation guarantees a feature will remain free or available forever. Optional paid terms may provide additional commitments.

## 9. Third-party services and intellectual property

Links, venues, creators, merchants, device services and identity providers are independent unless expressly stated otherwise. Their terms and practices may apply. We are not a party to a user's separate arrangements with them merely because the Service helped users discover them. Responsibility for TMD's own conduct remains subject to applicable law.

TMD and its licensors retain rights in the Service software, branding and materials other than user-owned Content. We give you a limited, personal, nonexclusive, nontransferable, revocable permission to use the Service as authorized by these Terms. Do not copy or exploit TMD branding/software except as permitted by us or law. Send IP concerns through our Copyright and IP Policy (https://trymydays.com/copyright/).

## 10. Warranty disclaimers

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND DO NOT WARRANT UNINTERRUPTED, ERROR-FREE OR SECURE OPERATION, CONTENT PRESERVATION, ACCURACY, RESULTS OR THE SAFETY OR CONDUCT OF USERS.

These disclaimers do not exclude a guarantee, condition, warranty, standard of care or remedy that applicable law does not allow us to exclude. In particular, mandatory consumer guarantees and privacy rights remain available as explained in the Country Addenda.

## 11. Liability limits

To the extent permitted by applicable law, TMD and its personnel and service providers acting in that capacity are not liable under these Terms for indirect, consequential, special, exemplary or punitive damages, or business losses of profits, revenue, opportunity, goodwill or reputation, arising from your use of or inability to use the Service, even if advised that such losses were possible. This exclusion does not remove compensation for a consumer's reasonably foreseeable loss where law does not permit its exclusion.

Subject to the exceptions below, our total aggregate liability arising out of or relating to the Service or these Terms, under any legal theory, will not exceed the greater of US$100 and the amount you paid to TMD for the relevant Service in the 12 months preceding the event giving rise to the claim. Related events are treated together only where law permits.

Neither this cap nor any exclusion limits liability for fraud or fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence where exclusion is prohibited, gross negligence where exclusion is prohibited, or any statutory liability, consumer remedy, privacy right or other liability that cannot lawfully be limited. These clauses do not limit your obligation to pay a validly authorized price or deprive you of a mandatory refund. Applicable Country Addenda qualify these provisions directly.

## 12. Responsibility for claims you cause

To the extent permitted by law, you will indemnify TMD and its personnel against reasonable third-party claims, damages and costs, including reasonable legal costs, to the extent caused by your unlawful Content, material breach of your rights warranties, or negligent or wilful unlawful conduct through the Service. For consumers, this obligation is limited to reasonably foreseeable loss attributable to your fault and does not apply where prohibited or unfair under applicable law. It does not cover the fault of the party seeking indemnity or liability that law does not permit transferring to you.

If you use the Service for a business, you also agree to defend covered claims with competent representation reasonably acceptable to us. We will give reasonable notice, allow appropriate control of the defence and reasonable cooperation at your expense, subject to privilege, conflicts and legal duties. No settlement may admit fault by or impose nonmonetary duties on us without our consent, not unreasonably withheld. We may participate with our own representation at our expense except where a genuine conflict or your failure to defend reasonably requires a separate defence. This paragraph does not impose a separate duty to defend on a consumer.

## 13. Ending the relationship and changes to Terms

You may stop using the Service and request deletion. We may end access on the grounds in section 6 or discontinue the Service. Accrued lawful obligations, necessary dispute provisions, liability rules and the limited surviving licence/evidence permissions remain to the extent their purpose requires. They do not revive terminated content rights.

We may update these Terms. We will identify the revised version and effective date and give reasonable notice of material changes where practicable and any notice required by law. We will seek renewed acceptance where required, including for a material expansion of an existing content grant. Changes apply prospectively unless you expressly agree otherwise or law requires otherwise. If you decline a change, we may discontinue future access to affected features; we will not treat refusal as agreement to expanded rights over prior Content. Existing claims remain governed by the terms and mandatory law applicable to them.

## 14. Governing law and general terms

British Columbia law and applicable Canadian federal law govern, except where mandatory local law requires otherwise. Courts in Vancouver, British Columbia have jurisdiction, but this does not prevent a consumer from using a mandatory local forum or relying on non-waivable local protections. There is no compulsory arbitration or class-action waiver in these Terms. You may contact support to seek a resolution; doing so is not a condition to exercising legal rights.

We may assign these Terms in a merger, reorganization, financing, business transfer or asset sale, provided the successor assumes applicable obligations and personal data is handled in accordance with law. We may disclose limited information for such a transaction with appropriate safeguards and provide legally required notice. You may not assign your obligations without our consent, except where law permits. No assignment expands the content licence or cancels mandatory remedies.

These Terms are the agreement for the Service, together with the documents expressly incorporated. If a provision is invalid, the remaining provisions continue where legally possible; a court may limit a provision only as law permits. Failure to enforce a provision is not a waiver. Nothing creates an agency, employment, partnership or joint venture with a user. Third-party beneficiaries exist only where expressly identified and enforceable. ## 16. Country Addenda for this Beta

## United States

Where an applicable state privacy law covers our processing, you may exercise the rights described in the Privacy Policy, including authorized-agent requests and applicable appeals. To appeal a denied request, email privacy@trymydays.com or support@trymydays.com, identify the decision, and say that you seek an appeal. If an appeal is denied, we provide the applicable regulator complaint route as required. We do not sell personal data, use cross-context behavioral advertising, or conduct consequential automated profiling in the initial Service.

For California, our Privacy Policy describes the categories collected, sources, purposes, recipient categories and retention. Where the CCPA applies, rights may include access/portability, correction, deletion, and opt-out or limitation rights applicable to our actual processing, without unlawful discrimination. A right may be subject to lawful verification and exceptions. Our current no-sale/no-sharing practice also applies to information of people under 16; we do not knowingly admit under 18 accounts. For Rhode Island, no third party is currently identified as a recipient to whom we sell or may sell personal data under an active sale arrangement because no such arrangement exists; a new practice requires an updated notice before activation.

For New Jersey consumers, the Terms' warranty exclusions, damages exclusions, cap and indemnity apply only to the extent New Jersey law permits. They do not exclude statutory consumer remedies or liability that such law makes non-excludable. For all US users, legal minority and contractual-capacity protections remain applicable even if TMD's account-age requirement is met.

## Canada excluding Quebec

The Service is not offered in Quebec. Applicable federal and provincial privacy rights may include access, correction, withdrawal of consent subject to legal/contractual limits, and a complaint to the responsible commissioner. A deletion request is assessed against the purposes and retention obligations applicable to the information; this policy does not invent a universal statutory erasure right. Our Privacy Officer can explain foreign-service-provider policies and practices, including for Alberta residents.

The Terms do not waive a consumer's statutory remedies, a non-waivable local court right or an applicable privacy right. Being 18 does not eliminate contractual-minority protections that apply in a province or territory. No compulsory arbitration or class-action waiver is imposed.
